Terms of Service

These Terms of Service ("Terms") are an agreement between you and CyberCrew Studios LLC ("CyberCrew," "we," "us," or "our") for your use of CyberCrew Arcade. Please read them before accepting. They take effect for you when you affirmatively accept them. If you do not agree, do not use account-based Arcade services. You may authenticate only to review and accept these Terms or use available account support, sign-out, and deletion options.

1. Scope and relationship to other agreements

"Arcade" means our Arcade website, player accounts, browser games, community features, virtual economy, supported wallet and external-game connections, and related services we make available under these Terms. A feature described here applies only where that feature is offered. These Terms do not promise that a feature, game, purchase, or integration is available now or will become available.

Quantum Frame is a separate game governed by its own Terms of Service and End User License Agreement. If you voluntarily connect Quantum Frame to Arcade, these Terms govern your use of Arcade and its connection services; the Quantum Frame agreement continues to govern the game. These Terms do not make an Arcade account necessary for features of Quantum Frame that are available without one.

Our separately published CyberCrew Arcade Privacy Policy describes how we process personal information. Accepting these Terms is not consent to optional marketing, tracking, or other processing for which separate consent is required. Additional purchase, event, competition, or asset-license terms apply only when disclosed before you enter into the relevant transaction or activity. Mandatory consumer rights always apply.

2. Adults-only Arcade access

You must be at least 18 years old and have legal capacity to enter this agreement where you live to create or use an Arcade account. Parental permission does not create an exception to Arcade's 18+ rule. Do not allow a person under 18 to use your Arcade account.

This Arcade age restriction does not establish the age requirement for the standalone Quantum Frame game. A person who is eligible to play Quantum Frame but is under 18 may not create an Arcade account or use Arcade account-linking features.

You must provide truthful eligibility information when requested. If we reasonably believe an account is being used by someone who is ineligible, we may restrict it while we investigate and take the steps described in our Privacy Policy.

3. Accounts and security

Your player account is separate from your wallets, NFTs, selected character, visual avatar, and accounts with other services. A wallet transfer or NFT sale does not transfer your Arcade account. You must not sell, rent, or share an Arcade account to bypass access rules or ownership checks.

Provide accurate information where required and protect access to your account and authentication methods. Tell us promptly at support@cybercrewstudios.com if you believe your account has been compromised. You are responsible for activity you authorize; these Terms do not automatically make you responsible for unauthorized activity caused by our failure to meet our obligations.

We may require proportionate verification before restoring access, changing a sensitive connection, or fulfilling an account request. We will not ask for a wallet recovery phrase or private key. Account recovery does not allow us to recover a lost wallet key or reverse a blockchain transaction.

4. Permission to use Arcade

Subject to these Terms, we grant you a limited, non-exclusive, personal, non-transferable permission to access and use the Arcade features made available to you. This permission lasts while the relevant service is provided and your access has not lawfully ended under these Terms.

CyberCrew and its licensors retain ownership of Arcade software, interfaces, artwork, trademarks, and other protected material, except for rights you already hold in your own content or under a separate asset license. You receive permission to use the service, not ownership of its software or an unrestricted right to redistribute its assets.

You may not copy, distribute, sell, sublicense, or extract Arcade software or protected assets except as expressly permitted by a separate license or applicable law. Restrictions on reverse engineering do not apply to activities that applicable law permits despite a contractual restriction. Third-party and open-source components remain subject to their applicable license notices.

5. Player conduct and fair play

You must not use Arcade to:

  • Cheat, manipulate matchmaking or rankings, collude to fabricate results, or obtain rewards through unauthorized automation, falsified replays, exploits, or altered clients.
  • Bypass eligibility, rate limits, security controls, account restrictions, ownership verification, or paid-access requirements.
  • Threaten, harass, stalk, dox, discriminate unlawfully, distribute sexual exploitation material, or encourage violence or illegal activity.
  • Impersonate another person or CyberCrew, conduct phishing or scams, distribute malware, spam other users, or interfere with the service.
  • Infringe intellectual property, privacy, publicity, or other rights, or submit content you have no right to use.
  • Access another person's account, private information, or wallet without authorization, or use Arcade to facilitate unlawful transactions.

Accessibility tools and ordinary permitted input devices are not prohibited merely because they assist a player. Tools that automate competitive play or confer an unauthorized advantage remain prohibited. If you discover a vulnerability, report it privately to support@cybercrewstudios.com and avoid accessing others' data, disrupting service, or exploiting it for gain.

6. Wallets, ownership checks, and supported unlocks

Wallet linking is optional for Arcade features that do not require an eligible asset. You may link supported wallets that you lawfully control, subject to verification and service limits. A primary wallet setting does not itself establish ownership of every item associated with your account.

An NFT or other digital asset unlocks Arcade content only when the specific network, collection, token, quantity, and applicable eligibility rules are supported. Similar artwork, a collection name, or a token symbol is not proof of compatibility. Consult the specific item's official description before acquiring it for an Arcade use.

We use ownership verification and game-side rules to determine access. Transfers, provider outages, conflicting observations, network reorganizations, or stale information can delay or temporarily restrict an unlock. A cached display or a temporary verification error does not grant permanent access. Report a missing eligible item so it can be investigated; support cannot guarantee that a third-party network or provider will recover within a particular time.

You retain control of your external wallet. Normal account linking and verification do not transfer assets to CyberCrew or authorize a purchase. Any separately offered on-chain transaction must disclose its own purpose and require the applicable authorization.

7. Ownership changes, quantities, and progression

Player progression, NFT-character progression, visual avatar selection, wallet ownership, and external-game access are distinct. Selecting a visual avatar does not itself change the NFT selected for progression. Owning an asset does not merge these records or entitle you to another player's account history.

Selling, transferring, or unlinking an eligible asset may end your access to associated content once the change is verified. A new eligible holder may obtain access after verification. Neither outcome is guaranteed to be instantaneous, and a token transfer does not transfer the former holder's player account, personal information, or account-wide currency balances.

For supported character records tied to a specific NFT identity, including supported ERC-721 characters, NFT-character progression may remain associated with that NFT through verified ownership changes. This does not mean that all progression is stored on-chain, that it cannot be corrected, or that every supported token has transferable progression.

For ERC-1155 assets, multiple units of a token type may be indistinguishable on-chain. Under Arcade's standard owner-copy system, character records are associated with the player and token type and are enabled according to verified quantity. If your eligible quantity falls, excess character records may become inactive; if it later increases, eligible retained records may reactivate. A buyer does not automatically receive the seller's individual owner-copy character record. A collection expressly configured for token-level progression may behave differently.

Multiple linked wallets can contribute eligible holdings to one account. Moving an asset between your linked wallets may still cause temporary verification delays. Owning additional units does not automatically multiply an external game's unlocks or guarantee unlimited playable character copies. Check the applicable feature and collection rules.

Progression and rewards are subject to the service's validation rules. We may correct duplicate, fraudulent, exploited, or incorrectly calculated records, with a reasonable opportunity to report mistakes. These Terms do not promise that Arcade progression, currencies, or achievements are recognized in every CyberCrew product.

8. Virtual currencies and purchases

Arcade may offer account-based virtual currencies, items, or access. An in-service balance, including a balance labeled Credits, Chrome, or CyberCoin, is not by that name alone a blockchain token, bank deposit, security, or claim to cash. Unless a specific offer expressly provides otherwise, account-based virtual balances cannot be redeemed for money or transferred outside authorized service features. This paragraph does not change ownership of actual blockchain assets held in your wallet.

Arcade does not authorize real-money wagering or the use of its balances to operate an unauthorized gambling service. Any officially offered competition with prizes must have its own disclosed eligibility and participation rules; ordinary play does not create a right to a cash prize.

Where purchases are enabled, the checkout must state what is supplied, its price, applicable taxes or fees, and any relevant conditions before you authorize payment. You must be authorized to use the payment method. We do not promise that earned balances, free items, or test purchases have a resale value.

If a subscription is offered, its renewal frequency, price, cancellation method, and other recurring-payment conditions must be presented before enrollment. Recurring charges require your affirmative authorization. Cancellation stops future renewals as described at checkout and does not remove any statutory refund or cancellation right. A subscription feature is not offered merely because these Terms discuss it.

Refunds, failed delivery, duplicate charges, and cancellations are handled under the applicable purchase terms, storefront or payment-provider process, and mandatory law. Contact support@cybercrewstudios.com for purchases made directly from CyberCrew. Nothing here imposes an unconditional no-refund rule or waives statutory remedies. If immediate digital delivery requires a separate acknowledgment or consent under local law, general acceptance of these Terms does not substitute for it.

9. External assets, marketplaces, and downloads

Third-party wallets, marketplaces, blockchains, payment services, and games have their own terms and operational risks. An official link identifies a destination; it does not guarantee a third party's security, availability, prices, or future compatibility. Confirm the network, contract, token, and license before purchasing.

Ownership of a token is distinct from copyright, trademark rights, commercial-use rights, and the right to use a game service. Those rights come from the applicable asset license and these Terms, not from token possession alone. Nothing in these Terms reduces an express license you independently received for a specific asset. Separate licenses do not grant access to unrelated CyberCrew services or override rights held by third-party licensors.

If Arcade provides private asset downloads, access may depend on verified ownership and temporary download authorization. A download link does not grant a broader content license. Do not share private access links or bypass download controls. The right to retain or use a downloaded file after a sale or transfer depends on that file's applicable license; these Terms do not create a universal rule for every asset.

CyberCrew does not guarantee token prices, liquidity, profits, appreciation, investment returns, or perpetual game support. Except for a separately described transaction you expressly authorize, Arcade does not act as custodian of your wallet assets or promise to reverse transactions. Nothing excludes responsibility or remedies that the law imposes on CyberCrew for its own conduct.

10. Your content and communications

You retain rights you own in content you submit. You grant CyberCrew a non-exclusive, worldwide, royalty-free license to store, reproduce, format, transmit, and display that content only as reasonably needed to operate the features you request, moderate the service, maintain security, and handle support. Service providers may exercise these rights on our behalf for those purposes.

This license does not transfer ownership of your content or authorize unrelated commercial resale. It ends when the content is removed from our systems, except for reasonable backup, legal, security, and recordkeeping retention and copies other users lawfully received through features you used. Personal-information handling remains governed by the Privacy Policy and applicable law.

You must have the rights necessary to submit the content. Public messages, profiles, and multiplayer activity may be visible to others. We may moderate or remove content that violates these Terms, but cannot promise to review every message or prevent all misconduct. Report abuse through available tools or support@cybercrewstudios.com.

11. Updates, tests, and service availability

We may maintain, update, balance, repair, or reasonably modify Arcade. Test and development features may be incomplete or unstable. We will identify material test restrictions and any planned reset of test progression before participation where reasonably practicable. There is no promise of a fixed update schedule, permanent availability, or release of roadmap features.

We will give reasonable advance notice of material adverse changes to paid access or permanent service closure where practicable, and provide any legally required cancellation, refund, or other remedy. Urgent security, legal, or technical changes may require immediate action. A balance change does not itself transfer or confiscate your external blockchain assets.

Network failures and validation checks can interrupt sessions or delay rewards. We will use reasonable care in operating the service, but cannot guarantee uninterrupted play, recovery of every interrupted session, or preservation of every record in every failure. These limitations do not excuse a failure to meet mandatory obligations.

12. Restrictions, suspension, and ending access

We may restrict features, remove prohibited content, correct improperly obtained rewards, or suspend or terminate access for a material or repeated breach, ineligibility, fraud, a credible security threat, or a legal requirement. We will use proportionate measures and, where reasonably practicable and lawful, explain the reason and allow you to correct a remediable breach. Immediate restriction may be necessary to protect users, evidence, or the service.

You may ask us to review a restriction by contacting support@cybercrewstudios.com with relevant account details. A request does not guarantee reinstatement. Do not provide passwords, recovery phrases, or private keys. These Terms do not impose a deadline that cuts off statutory appeal or complaint rights.

You may stop using Arcade and request account deletion using the process in the Privacy Policy. Deletion does not itself cancel a subscription billed by an independent provider; use the cancellation process shown for that subscription, and contact us if you need help. Ending access does not authorize us to seize assets in your external wallet or deny a refund required by law.

13. Service warranties and limitations

Except for express commitments and rights that cannot lawfully be excluded, Arcade and free or test features are provided as available, without a promise that they will be error-free or meet every personal expectation. To the extent permitted by applicable law, CyberCrew disclaims implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement. Where law requires reasonable care, digital-content conformity, updates, repair, replacement, or other consumer remedies, those duties and remedies remain.

To the extent permitted by applicable law, CyberCrew is not liable for indirect or consequential business losses, lost business profits, or speculative changes in digital-asset value arising from your use of Arcade. This exclusion does not remove liability for a consumer's foreseeable loss where applicable law requires compensation.

Where a contractual liability cap is permitted, CyberCrew's aggregate liability arising from these Terms is limited to the greater of US$100 or the amount you paid directly to CyberCrew for the affected Arcade service in the 12 months before the event giving rise to the claim. The cap does not limit refunds or other mandatory remedies, or liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. It does not cap a third-party provider's independent obligations to you.

14. Disputes and applicable law

Please contact support@cybercrewstudios.com so we can try to resolve a concern. Informal discussion is encouraged but is not a mandatory waiting period and does not prevent a timely court claim, regulator complaint, or use of another available remedy.

To the extent permitted by applicable law, these Terms are governed by Delaware law, without its conflict-of-law rules, and disputes may be brought in state or federal courts in Delaware with jurisdiction. If mandatory consumer law gives you protections or a right to bring proceedings where you live, those protections and forum rights are preserved; this clause does not make Delaware your exclusive forum in that situation.

These Terms do not require private arbitration and do not waive class-action, jury-trial, or small-claims rights that you otherwise have. There is no contractual shortening of statutory limitation periods.

15. Changes and general provisions

We may revise these Terms prospectively. We will identify the updated version and provide reasonable notice of material changes through the service or appropriate account communications. We will request renewed affirmative acceptance where required or where a material change to the agreement warrants it. Updated terms do not retroactively rewrite completed transactions or existing disputes. If you do not agree to a proposed change, you may stop using the affected service and retain any applicable cancellation or refund rights.

If a provision cannot be enforced, it is severed to the extent necessary and the remaining provisions continue where lawful. A delay in enforcing a provision is not a permanent waiver. You may not transfer your account or these Terms without our permission, except where law requires otherwise. We may transfer the service and this agreement as part of a legitimate business transfer only subject to applicable law, privacy obligations, and your mandatory rights; doing so does not reduce obligations already owed to you.

These Terms, together with applicable transaction and feature terms, form the agreement for Arcade. Specific transaction terms govern the transaction they describe. No term overrides mandatory law or an independent third-party license. Provisions that by their nature must continue after access ends, including payment obligations already incurred, intellectual-property rights, lawful limitations, and dispute provisions, continue to that extent.
